Cancellation policy for consumers
A consumer within the meaning of this cancellation policy is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
1. Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The period begins on the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us – FlaveAir GmbH, Daimlerstraße 14, 45891 Gelsenkirchen, email: hello@flave-air.com, phone: 0209 5130448 – of your decision to withdraw from this contract by means of a clear statement (e.g., by letter or email). You can use the following sample withdrawal form for this purpose, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification before the 14-day period expires.
2. Exceptions to the right of withdrawal
There is no right of withdrawal for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery. For legal reasons (§ 312g para. 2 no. 3 BGB), the right of withdrawal is excluded for products whose seal has been removed after delivery for reasons of hygiene or health protection. This means that FlaveAir goods that have already been opened cannot be returned or refunded. Unopened and originally sealed products can, of course, be returned within the statutory period. Once we have received and checked your return, we will refund the purchase price using the same payment method you used when placing your order.
2.1. Returning promotional sets
Our promotional sets (e.g., starter sets, value packs, or special bundles) include a combined price reduction on the entire package.
In order for us to offer this discount fairly, returns or cancellations are only possible for the complete set.
Unfortunately, it is not possible to return individual items within a promotional set. The basis for this is § 357 (1) BGB in conjunction with § 355 BGB, according to which the entire contract always applies in the event of cancellation.
Please also understand that products that have already been opened or unsealed and cannot be resold for hygienic reasons (§ 312g (2) No. 3 BGB) are generally excluded from return.
3. Consequences of revocation
If you revoke this contract, we will refund all payments received, including standard delivery costs (except for additional costs incurred due to a more expensive shipping method chosen by you), immediately and at the latest within 14 days of receiving your revocation notice.
We will use the same means of payment for the refund that you used for the original order, unless expressly agreed otherwise. You will not incur any refund fees.
We may refuse to refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.
4. Returning the goods
You are obliged to return or hand over the goods to us immediately and at the latest within 14 days of the day on which you informed us of your withdrawal.
The deadline is met if you send the goods before the 14-day period expires. You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this is due to handling that is not necessary for checking the condition, properties, and functionality.
5. Information on returns (voluntary, not a requirement)
Please do not return the goods carriage forward – packages sent carriage forward cannot be accepted.
Return the goods as a prepaid package to the specified return address and keep the proof of posting in a safe place until the refund has been made.
Please ensure that the goods are undamaged and, if possible, in their original packaging.
